This is the first step in the process, where you formally ask the court to appoint a guardian for a minor or incapacitated adult.
The proposed guardian must notify all interested parties, and the person in question may undergo an evaluation to determine whether a guardian is necessary.
After reviewing all evidence, the court will officially appoint a guardian and issue an order outlining the guardian’s responsibilities and authority.
In some cases, the court appoints a Guardian ad Litem — an independent advocate who represents the best interests of the person in need of guardianship.
Once appointed, the guardian must file a detailed inventory of the person’s assets and provide annual reports to the court showing how those assets are managed.
Termination occurs when a guardian is no longer necessary — whether due to the person regaining capacity, reaching adulthood, or passing away. — and the court must formally approve the termination.
